MIAA STATEMENT REGARDING TOURNAMENT PHOTOGRAPHY

Perhaps it is improved technology that has produced an increasing number of individuals who wish to photograph during MIAA sponsored tournament events, with the intent of selling those pictures from a web site. At the present time, the Association does not permit such commercial activity. Because participants (including athletes, cheerleaders, and band members) are children, there is an added concern that these young people could be exploited were the Association not to preclude the photographing, website posting, and sale of these photographs.

The Association has requested its General Counsel to consider developing a contract which the Association might execute with legitimate photographers. This contract would include language that would mitigate concerns the Association has with respect to the privacy and protection of young people.
